Crime Victim's Rights

• Apply for financial help if you are a victim of a crime that harmed you or killed a family member.

• A support person
• A meaningful role in the justice process
• Dignity and respect
• Fair and impartial treatment
• Reasonable protection

If the state pursues criminal prosecution, you also have the right to:

• Speak at the pre-trial release hearing
• Request certain conviction, criminal history and imprisonment information
• Request a court order to keep the defendant from contacting you
• Keep your phone number and address from the defendant
• Request an HIV test of the defendant if the crime involves transmission of bodily fluids
• Request notice of court proceedings before they take place. You may attend open court proceedings even if you don't ask to beforehand
• Request that the district attorney consult you about a plea offer in a violent felony case
• Request a transcript of open court proceedings
• Have the court consider your schedule if a trial date is set
• Choose to give or to refuse to give information to an attorney or private investigator working for the defendant or alleged youth offender

The first hearing in a case can come within hours of an arrest. If you are concerned about someone's release from custody after an arrest, contact your district attorney's office or juvenile department immediately.

If the alleged youth offender or defendant is convicted, you have the right to:

• Receive prompt restitution
• Be present at sentencing or disposition and to give a victim impact statement

You may have other rights if you are a victim:

• Who is an immigrant to the United States
• Of family, elder, or disabled person abuse
• Of sexual assault
• Of stalking
• Of other crimes

Domestic Violence

If you are the victim of domestic violence or abuse, you can ask the district attorney to file a criminal complaint. You also have the right to go to the circuit court and file a petition requesting any of the following orders for relief:

1. an order restraining your attacker from abusing you;
2. an order directing your attacker to leave your household;
3. an order preventing your attacker from entering your residence, school, business or place of employment;
4. an order awarding you or the other parent custody of or parenting time with a minor child or children;
5. an order restraining your attacker from molesting or interfering with minor children in your custody;
6. an order awarding you other relief the court considers necessary to provide for you or your children's safety, including emergency monetary assistance. Such orders are enforceable in every state.

You may also request an order awarding support for minor children in your care or for your support if the other party has a legal obligation to support you or your children. You also have the right to sue for losses suffered as a result of the abuse, including medical and moving expenses, loss of earnings or support, and other out-of-pocket expenses for injuries sustained and damage to your property. This can be done without an attorney in small claims court if the total amount claimed is under $3,500.
